Visitor Agreement for Goldberg Companies, Inc./GCI Residential/GCI Construction (hereinafter “GCI”) Community and Management Company Websites

 

Welcome to GCI’s internet site. By using this website, you accept the terms of this Visitor Agreement. Please read this Agreement carefully.

• 1. General Provisions.

GCI respects your privacy. Please take a moment to review our privacy policy. The Web is an evolving medium. We may change the terms of this Agreement from time to time. By continuing to use this website and following our posting of such changes, you agree to be bound by this Agreement, as modified. We may change, restrict access to, suspend, or discontinue this website, or any portion of this website, at any time. The material that appears on goldbergcompanies.com and gciresidential.com is for informational purposes only. Despite our efforts to provide useful and accurate information, errors may appear from time to time. We invite you to bring to our attention any material on our site that you believe to be inaccurate. • 2. Contacting our Apartment Communities.

Goldbergcompanies.com/gciresidential.com provides you the information you need to contact the apartment community or communities that interest you. You may also visit any of these communities in person. If you prefer, you may call at the telephone number they have provided, or you may learn more by sending an email. If you do choose to call or email a community, we want you to know that using the toll-free or local numbers or sending an email will result in your establishing a business relationship with us, which allows us to respond to you or to communicate with you for a future period through telephone calls, email or facsimile. Also, when you call our apartment communities at the toll-free or local numbers, your origination phone number will be captured along with the date and time of the call and your name and address may also be captured, if available.

• 3. Renting or Leasing Property.

Goldbergcompanies.com/gciresidential.com is a service we provide to help bring us together with prospective residents. The price and other terms of any lease remain subject to direct negotiation between us. While it is our intent to act honorably and treat everyone fairly, please be aware that if you apply to be a resident at one of our communities and if you actually become one of our residents, the documentation related to those transactions will control if there are any differences between that documentation and the information you find here at goldbergcompanies.com/gciresidential.com.

• 4. Links to Other Sites.

For your convenience, we may make available a variety of links to other websites that we don't operate where you can obtain related products and services, including but not limited to rent payment, credit and background checks, online apartment availability, utility connection, and lease information. GCI  is not responsible for the products or services these vendors provide. You release GCI and its affiliates from any damages that you may incur, and agree not to assert any claims against them, arising from your purchase or use of third-party supplied products and services.

• 5. Ownership and Permissions.

Goldbergcompanies.com/gciresidential.com is made available for your personal, non-commercial use only as you search for your new apartment home. If you are a vendor to the apartment industry, you are not to use this site as a means of communicating with us. The materials on this site are the property of GCI or its affiliates or licensors, and are protected by U.S. copyright laws, other copyright laws, and international conventions. Except as explicitly provided in this agreement, you may not distribute, transmit, display, reproduce, modify, create derivative works from, or otherwise exploit any of the materials on this site. You may display and occasionally print a single copy of any page on the site for your personal, non-commercial use, but you may not otherwise reproduce any material appearing on this site without our prior written consent. You may not store any significant portion of, nor distribute copies of, materials found on this site in any form (including electronic form), without prior written permission from us. To obtain access to certain gciresidential.com and goldbergcompanies.com services, you will be given an opportunity to register with us or RentPayment.com. As part of the registration process, you will select a user name and a password. You agree that the information you supply during that registration process will be accurate and complete and that you will not register under the name of, nor attempt to enter the service under the name of, another person. We reserve the right to disallow use of user names that we deem offensive or inappropriate. You will be responsible for preserving the confidentiality of your password and for all actions of persons accessing goldbergcompanies.com/gciresidential.com through any username/password assigned to you.

• 8. Miscellaneous.

We will not engage in spamming or any unauthorized and preapproved data scrapping. We want our potential residents using goldbergcompanies.com/gciresidential.com to feel free to share their email addresses with us. We agree to use your email address only for purposes of communicating with you about the potential of you becoming our resident, or once a resident in our community, communicating information related to your occupancy in your apartment home and our apartment community.  This Visitor Agreement has been made in, and will be construed in accordance with the laws of State of Ohio. By using this website, you consent to the exclusive jurisdiction and venue of the state and federal courts in Cuyahoga County, Ohio, with respect to all disputes arising out of or relating to this Agreement or use of this website.
